This website at heycapy.store (the “Website”) is operated by HỘ KINH DOANH KOMBUCHA CAPY, a household business registered in Vietnam (“Capy”, “we”, “us”). We produce and sell kombucha, a fermented tea beverage.

The Website is an information and contact channel. It presents our flavours, bottle options and prices, and tells you how to reach us to place an order.

By using the Website or placing an order with us, you agree to these Terms. If you do not agree with them, please do not use the Website or order our products.

If you are under the age at which you can enter into a contract on your own, please ask a parent or guardian to order for you.

Capy is a small kombucha producer in Vietnam. We brew in small batches and bottle our drinks for sale directly to customers.

We currently deliver in a limited number of areas in Vietnam. The areas we serve are shown on the Website and may change over time.

You may browse the Website freely. No account or login is required to view our product information.

We try to keep the Website available and working correctly, but we cannot promise it will always be online or free of errors. We may update, pause or withdraw parts of the Website at any time.

We describe our flavours, ingredients, bottle sizes and storage instructions as accurately as we can. Because kombucha is a naturally fermented drink made in small batches, some natural variation is normal:

• Colour and taste can differ slightly between batches, as we do not use colouring or stabilising additives.
• Sediment may settle at the bottom of the bottle. This is a normal result of fermentation.
• Our bottles develop natural carbonation, so please open them slowly.

Product photographs are for illustration. The bottle you receive may look slightly different from the images on the Website.

Not medical advice. Information on the Website is general information about a beverage. Our products are food and drink products, not medicines, and we do not offer them as a treatment for any condition or promise any specific health result. If you have a health condition, are pregnant, or are unsure whether a fermented drink suits you, please speak to a qualified healthcare professional.

All products are subject to availability. Because we brew in small batches, a flavour or bottle size may sell out or be temporarily unavailable.

Listing a product on the Website is not a guarantee that we have it in stock. We will tell you what is available when you contact us to order.

Prices shown on the Website are in Vietnamese Dong (VND) and are for single bottles unless stated otherwise. Prices may change, and the price that applies to your order is the one we confirm with you when the order is placed.

Delivery charges are not included in the product price. They depend on distance and are quoted to you before you confirm your order.

We normally ask for a partial deposit to reserve your order, with the remaining balance paid on delivery. We will tell you which payment methods we accept when confirming your order.

If a price or product detail on the Website is obviously wrong due to a mistake on our side, we will let you know before processing the order and you may choose to continue at the corrected price or cancel.

Orders are not placed through an automated checkout on this Website. To order, you contact us using the phone number or messaging channels shown on the Website, and tell us the flavours and quantities you would like.

We then confirm the items, the total amount and the delivery fee with you. An order is only accepted once we have confirmed it with you. Until then, your request is an enquiry rather than a binding order.

For some orders we may send you a link to view the order details and delivery status. Such links are private and intended only for the customer who received them.

We deliver within the areas listed on the Website. Deliveries are usually arranged through third-party delivery providers.

• Delivery times are estimates. Traffic, weather and courier availability can cause delays.
• Please provide a correct address and a phone number that can be reached, so the courier can deliver successfully.
• Our drinks need to stay cool. Please arrange to receive your order promptly and refrigerate it on arrival.
• If nobody can receive the order at the agreed time and place, additional delivery costs may apply.

Where delivery is carried out by a third-party provider, that provider’s own terms also apply to the delivery itself.

Because kombucha is a fresh, perishable food product, we generally cannot accept returns of bottles that have been delivered correctly and in good condition.

We will put things right if there is a problem with your order, such as:

• bottles that arrive broken, leaking or damaged;
• missing items compared with the order we confirmed;
• the wrong flavour or bottle size sent;
• a product that is clearly not in acceptable condition on arrival.

Please contact us as soon as possible after delivery and, if you can, take a photo or short video when you open the package. This helps us resolve the issue quickly. Depending on the situation, we may replace the item, arrange a partial refund or refund the order.

Nothing in these Terms limits any rights you have under the consumer protection laws of Vietnam.

Our kombucha is a live fermented product and is not heat-treated to stop fermentation. To keep it at its best:

• Keep bottles refrigerated and out of direct sunlight and heat.
• Open bottles slowly, as natural carbonation can build up inside.
• Once opened, close the cap tightly, keep the bottle refrigerated and drink it within a reasonable period.
• Check the expiry date printed on the bottle and consume it before that date.

Please follow the storage instructions on the bottle and on the Website. We cannot take responsibility for products that have not been stored as instructed after delivery.

The Capy name, logo, label designs, product photographs and Website content belong to us or are used with permission. Please do not copy, reproduce or use them for commercial purposes without our written permission.

You may share links to the Website and use our public content for ordinary personal or editorial purposes, such as posting about a product you bought.

Some parts of the Website let you send us information. For example, our collaboration page includes a form where content creators can submit their contact details and information about their channels if they would like to work with us.

When you send us information, please make sure that:

• the information is accurate and belongs to you or you are allowed to share it;
• you do not submit anyone else's personal information without their permission;
• you do not send unlawful, misleading or offensive content.

Submitting a collaboration form does not create any partnership or obligation on our side. We may decide not to reply to or proceed with a submission.

How we handle personal information is explained in our Privacy Policy.

When using the Website, please do not:

• use it for any unlawful purpose or in breach of these Terms;
• attempt to gain unauthorised access to the Website, our administrative area, our systems or another customer's order information;
• interfere with or disrupt the normal operation of the Website, for example through automated scraping that places an unreasonable load on it;
• resell our products as your own or misrepresent your relationship with Capy;
• copy the Website to create a misleading or competing site.

The Website may link to third-party services, such as messaging apps, social media profiles or delivery providers. We also rely on third-party providers for website hosting and data storage.

We do not control third-party services and are not responsible for their content, terms or privacy practices. When you use them, their own terms and policies apply.

The Website and its content are provided on an “as is” basis. While we take care to keep product information accurate and up to date, we do not guarantee that everything on the Website is always complete, current or free from error.

We do not make any health, medical or therapeutic claims about our products. Individual experiences with fermented drinks vary.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Website, such as lost profits or lost business opportunities.

We remain responsible for the products we sell you in accordance with applicable Vietnamese law. Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited — including liability for death or personal injury caused by our negligence, for fraud, or for our obligations under consumer protection and food safety law.

We may update these Terms from time to time, for example when our products, delivery areas or ordering process change. The current version is always published on this page, with the “Last updated” date shown at the top.

Changes apply from the date they are published. Orders already confirmed are handled under the Terms that applied when we confirmed them.

These Terms and any order placed with us are governed by the laws of the Socialist Republic of Vietnam.

If a disagreement arises, we would like to resolve it with you directly first — please contact us and we will do our best to find a fair solution. If that is not possible, the matter may be brought before the competent Vietnamese authority or court in accordance with Vietnamese law.
